IMPORTANT – PLEASE CAREFULLY READ AND UNDERSTAND THESE TERMS AND CONDITIONS OF USE & SALE (THESE “TERMS”) BEFORE ACCESSING, USING, OR SUBSCRIBING OR PLACING AN ORDER OVER WWW.CAMPSHARKSMARTS.COM OR OTHER OF OUR SITES WHICH LINK TO THESE TERMS.

THESE TERMS CONTAIN DISCLAIMERS OF WARRANTIES AND LIMITATIONS OF LIABILITIES INCLUDING ARBITRATION AND CLASS ACTION WAIVER PROVISIONS THAT WAIVE YOUR RIGHT TO A COURT HEARING, RIGHT TO A JURY TRIAL, AND RIGHT TO PARTICIPATE IN A CLASS ACTION. ARBITRATION IS MANDATORY AND IS THE EXCLUSIVE REMEDY FOR ANY AND ALL DISPUTES. THESE TERMS FORM AN ESSENTIAL BASIS OF OUR AGREEMENT.

TERMS AND CONDITIONS

Please READ carefully, as this pertains to the Agreement of your registration with any of the products sold (sometimes referred to as Program) by Camp Shark Smarts (sometimes referred to as “Company”). By purchasing our products, you (sometimes referred to as "Client") agree to the following terms stated.

PROGRAM

Camp Shark Smarts agrees to provide course content, identified as an online course aid, to share suggestions in which Clients might choose to offer a business service to others. Client agrees to abide by all policies and procedures outlined in this Agreement as a condition of their participation in any of our programs.  

DISCLAIMER

Client understands Jonathan Pierce and Camp Shark Smarts, is not an employee, agent, lawyer, doctor, manager, therapist, public relations or business manager, registered dietician, or financial analyst, psychotherapist or accountant. Client understands their participation in this program will not treat or diagnose any disease, illness, or ailment and if they should experience any such issues they should see their registered physician or other practitioner as determined by their own judgment.

Client understands that neither Jonathan Pierce, nor Company, has promised, nor shall be obligated to, the following:

(1) Success in business, results, and sales for the Client.

(2) Provide assistance, as either coach or mentor, with consultations for future business contracts made by Client.

(3) Procure any publicity, social media exposure, interviews, write-ups, features, television, or print promotions for the Client.

(4) Introduce Client to Jonathan’s full network of contacts, media, or business partners. Client understands that a relationship does not exist between the Parties after the conclusion of the program's return policy period.

FINANCIAL OBLIGATION

Client is responsible for the completion of all payment plans associated with products they purchase. We reserve the right to seek recovery of any monies remaining unpaid via our Collection Agency.  

METHODS OF PAYMENT

We accept Visa, Mastercard, and American Express as a form of payment. If Client chooses to pay by monthly installments, he/she authorizes the monthly charge for the product on the Client`s credit card or debit card. 

REFUNDS

We DO NOT offer refunds on our Camp Shark Smarts program.

Please note: If you opted for a payment plan, you are required by law to complete your payment plan. We reserve the right to seek recovery of any monies remaining unpaid via our Collection Agency.

CONDITIONAL GUARANTEE

We offer a 30-day Conditional Guarantee. We do not offer refunds.

To request consideration for the Guarantee, Clients are required to complete the course, and submit a Debrief from any of the strategies taught in Camp Shark Smarts. Although we assume it goes without saying, if the debrief reveals you did not complete each step of the course, the return request will be denied.

Please note:

All returns and refunds are discretionary as determined by Camp Shark Smarts. If you have any questions, contact us at contact@campsharksmarts.com.

As mentioned above, all returns are discretionary. If you just downloaded the Training Material (PDFs, audios, videos, and/or etc.), and then promptly asked for a return, we reserve the right to deny your request. Why? Because the point of the policy is to give people the chance to try the system, and if it doesn't work, they can get their money back. It wasn't designed to enable people to steal the Training Material. The conditional guarantee period ends after 30 days.

CONFIDENTIALITY

Level Five Publishing, LLC respects Clients’ privacy and insists that the Client respects ours as well. Thus, consider this a mutual non-disclosure Agreement. Any confidential information shared by Level Five Publishing, LLC Participants or any representative of Level Five Publishing, LLC is confidential, proprietary, and and belongs solely and exclusively to the Client or representative who discloses it. Parties agree not to disclose, reveal, or make use of any confidential information or any transactions during discussions, in the forum or otherwise.

Client agrees not to use such confidential information in any manner other than in discussion with other Clients, or James, during the respective program. Confidential information includes, but is not limited to, information disclosed in connection with this Agreement, and shall not include information rightfully obtained from a third party.

Both Parties will keep private information in strictest confidence and shall use their best efforts to safeguard the confidential information and to protect it against disclosure, misuse, espionage, loss, and theft.

Client agrees not to violate the Publicity or Privacy Rights belonging to Level Five Publishing, LLC. Furthermore, Client will NOT reveal any information to a third party obtained in connection with this Agreement or our direct or indirect dealings with Client, including but not limited to, names, email addresses, third-party company titles or positions, phone numbers, or postal addresses. Additionally, Client will not, at any time, either directly or indirectly, disclose confidential information to any third party.

By purchasing our products, you agree that if you violate or display any likelihood of violating this Agreement, Level Five Publishing, LLC and/or the other program participant(s) will be entitled to injunctive relief to prohibit any such violations to protect against the harm of such violations.

PRODUCT & SERVICE RECOMMENDATIONS

Throughout the course, Camp Shark Smarts may recommend third party products & services that could be helpful to you. These products & services are operated independently by third parties and are simply being presented as tools that could be helpful to you. If you decide to use any of these products or services, it is your responsibility to conduct your own research and due diligence before doing so. Although Camp Shark Smarts may recommend a product or service, it is ultimately your decision to use the product or service of your choice.

IMPORTANT DISCLAIMER

You understand that the purpose of Camp Shark Smarts is to offer insight into many different ways you can use your creativity to earn income as a business owner and that Camp Shark Smarts is simply sharing practical concepts and ideas to help you form and make your own decisions. You understand it is ultimately your responsibility to decide what actions you will take in regard to anything you have learned at Camp Shark Smarts and that in doing so you accept full responsibility for those actions. You understand that by providing a service or product, your action or inaction can cause you to be responsible and/or liable. Furthermore it is your responsibility to do your own research and seek council in relation to any service or product you personally decide to offer. You understand it is possible to lose money in the process of attempting to earn money. Camp Shark Smarts does not gaurantee you will make money or achieve results of any kind.

INSURANCE, LICENSE, CERTIFICATION & CONDITIONAL RELATED REQUIREMENTS

You understand it is your responsibility to learn of any insurance, license, certification or any other such conditions required by the city, state, or government where you live, that could be necessary in order to offer the business or service you provide.
